There was a motion to accept the minutes of the January 31st meeting.  The motion was seconded and accepted with a vote of 7-0-0.

Continued - Public Hearing – Notice of Intent – DPW Garage Well Nos. 1&2 Miscellaneous Work – Town of Franklin - CE159-961

Mr. Bill Yadisernia, Town Engineer, appeared before the Commission to remove an existing steel culvert pipe and replace with new pipe, install new paved driveway and stone swale.

Mr. Yadisernia stated that this project is for 2 separate items of work.  One of which is to replace a broken 12” diameter culvert pipe which runs under the access road.  The other portion of the work is for an approximately 12 ft.x24 ft. extension of the paving at the locaton of the pumphouse for Well #2 at the end of the access road.

Mr. Yadisernia informed the Commission that he has depicted the haybales on the plan that was requested by the Conservation Agent.  Mr. Yadisernia also stated that a copy of a letter from Natural Heritage has been received and this has been added to the file.  Also, a DEP file number has been received.

A Commission member asked Mr. Yadisernia if the pipe running under the road has been repaired and also questioned the location of the swale and if the large boulder on the site will remain in the same location.  The question was asked if there will be grading beyond the trap door to the well.  Mr. Yadisernia informed the Commission that there will be no grading within the wetland.

The Commission Chairman noted that there was no one in the audience who had any issues regarding this project.

There was a motion to close the hearing.  The motion was seconded and accepted with a vote of 7-0-0.


Continued - Public Hearing – Notice of Intent – Colt Road Proposed Headwall Replacement – Town of Franklin - CE159-962

Mr. Bill Yadisernia, Town Engineer, appeared before the Commission for the removal of an  existing headwall and installation of new concrete headwall with storm drain piping.  There will be a new headwall with precast concrete to be located approximately 20 ft. from where it is currently located.  There will be a sediment basin to remove the silt from the existing stormwater discharge and it will be moved further back from the brook.

Mr. Yadisernia informed the Commission that a DEP file number has been received.

There was a motion to close the hearing.  The motion was seconded and accepted with a vote of 7-0-0.

There was a motion to issue State and Local Orders of Conditions for this project.  The motion was seconded and accepted with a vote of 7-0-0.


Continued - Public Hearing – Notice of Intent – Lot 1 Marine Way – Boudreau – CE159-956

Mr. Steve Poole of Inland Survey appeared before the Commission for the construction of a single-family house.  Mr. Poole presented the Commission with revised plans and stated that the plantings have been pushed up as far as possible to the toe of the slope.  There will be a double erosion control barrier; one is haybales and silt fence installed at the toe of the slope and below the plantings, there will be a silt fence barrier.  These plantings will be certified that they are viable by a botanist.

Mr. Poole stated that the construction sequence requested by the Commission has been added to the plans.  The planting plan has also been added to the plan.  The haybale and silt fence barrier has also been moved up to the limit of future disturbance.

A Commission member asked about the old brick wall and could it be brought to the edge of the resource area to add an additional natural buffer to the resource area.


A Commission member suggested that the removal of the Japanese Bittersweet located at the east side of the site be a possible Special Condition in the Orders of Conditions.

The Commission Chairman noted that there was no one in the audience who had any issues regarding this project.

There was a motion to close the hearing.  The motion was seconded and accepted with a vote of 7-0-0.


Continued - Public Hearing – Notice of Intent – Lot 2 Marine Way – Boudreau – CE159-957

Mr. Steve Poole of Inland Survey appeared before the Commission for the construction of a single-family house.  Mr. Poole presented the Commission with revised plans and stated that the construction sequence has been added to the plans as well as the planting plan.  The plantings will be placed up tight to the slope with a double barrier and there are invasive species on this lot.

The Commission Chairman noted that there was no one in the audience who had any issues regarding this project.

There was a motion to close the hearing.  The motion was seconded and accepted with a vote of 7-0-0.


Continued - Public Hearing – Notice of Intent – Lot 3 Marine Way – Boudreau – CE159-958

Mr. Steve Poole of Inland Survey appeared before the Commission for the construction of a single-family house.  Mr. Poole presented the Commission with revised plans and stated that they are proposing to double the number of plants on Lot 3 because of the length of the resource area.

The Commission Chairman noted that there was no one in the audience who had any issues regarding this project.

There was a motion to close the hearing.  The motion was seconded and accepted with a vote of 7-0-0.


Continued - Public Hearing – Notice of Intent – Beaver St. Culvert Replacement – Town of Franklin - CE159-959

Mr. Bill Yadisernia, Town Engineer, and Mr. Chris Roy, a representative of the Beta Group, both appeared before the Commission for the replacement of corrugated metal pipe culvert with reinforced concrete pipe culvert.  Mr. Yadisernia informed the Commission that this is for the  replacement of 2 48” corrugated culvert pipes with two new culvert pipes in the same location.

Mr. Yadisernia stated that the proposed work will take approximately 2 weeks.

Mr. Yadisernia also informed the Commission that a letter has been received from Natural Heritage.  Also, he stated that a DEP file number has been received.

Mr. Alfieri informed the applicant of 1 item to be addressed in this Notice of Intent filing.

A Commission member stated that on the west side of the roadway there is a large colony of Japanese Knotweed, which is an invasive species.  This will be harmful in the riparian area to Mine Brook.  It was suggested that this be eradicated from the site in order to avoid future damage to the riverfront area.  It was also suggested that this be a Special Condition in the Orders of Conditions that this be removed from the area by the Town if the opportunity exists in the future, if it is feasible and there is sufficient time in the schedule.

Mr. Alfieri will meet Mr. Yadisernia at the site to determine the location of these invasive species on the site and discuss the options for the above-mentioned work.

The Commission Chairman noted that there was no one in the audience who had any issues regarding this project.

Continued - Public Hearing – Notice of Intent – Map 292, Parcel 2 Spring Street – Maggiore - CE159-951

Mr. Donald Nielsen, Engineer of Guerriere & Halnon, Mr. Paul Maggiore & Mr. Matthew Maggiore of the Maggiore Companies, all appeared before the Commission for the roadway improvements on Spring Street.

Mr. Nielsen stated that at the Conservation meeting on January 17th, he addressed the issues in a letter submitted to the Conservation Agent and made an overview of a series of issues that were raised through the LEC Consultants.  Mr. Nielsen reviewed the contents of his letter to LEC to the Commission.  

Mr. Neilsen stated that the applicant is providing retaining walls on both sides of the proposed roadway and provided a letter to LEC with the plans for the replication and retaining walls.  The permanent disturbance is 11,000 sq. ft. with 18,800 sq. ft. of replication being proposed.

Mr. Nielsen submitted revised plans for the replication and roadway alignment.  There will be a 4x8 ft. passageway under the roadway to provide for a wildlife corridor.


Mr. Neilsen informed the Commission that he has made the changes requested by Mr. Yadisernia regarding the 6” sump in the two detention basins and the riprap at the outlet to address the concerns regarding the runoff from the site.

A Commission member requested that the Commission speak to DEP representatives to obtain their opinion of this project as is recommended by LEC Consultants.  The Chairman stated that any comments from DEP would be contained in their letter submitted to the applicant and the Conservation Department with the DEP file number.

Mr. Alfieri stated that he could speak to the DEP representatives at the Central Office and have the representative verify the fact that they have already reviewed this project as a Limited Project.  The Commission Chairman stated that, in his opinion, if the DEP has been contacted about this project as a Limited Project and if they have not commented yet on this project, they have reviewed it and agree with how it is being applied.  

Another Commission member stated that the Commission has the discretion whether or not they vote to approve a project and issue the Orders of Conditions.

It was the consensus of the Commission that the DEP does not have to be contacted based upon previous application and correspondence.

A Commission member questioned Mr. Nielsen if he could add rain gardens to the plan and he responded that he will put them on the site plans but has no room on this plan for the roadway itself.

There was a motion to close the hearing.  The motion was seconded and accepted with a vote of 7-0-0.


Continued - Public Hearing – Notice of Intent - Franklin Sports Mall – Washington Street -  SE159-923

The Commission Chairman stated that a letter has been received dated February 21st from the applicant’s engineer requesting a continuance of the public hearing until March 20th.

There was a motion to continue the hearing until March 20th.  The motion was seconded and accepted with a vote of 7-0-0.


Continued - Public Hearing – Amendment Request – 438 W. Central St. – Ayoub Engineering - SE159-862

The Commission Chairman stated that a letter has been received dated February 19th from the applicant’s engineer requesting a continuance of the public hearing until April 24th.  

There was a motion to continue the hearing until April 24th.  The motion was seconded and accepted with a vote of 7-0-0.

GENERAL BUSINESS
        
        Certificate of Compliance:  13 Bubbling Brook Drive – SE159-401
        Mr. Alfieri informed the Commission that an Orders of Conditions was recently issued to         the applicant and it was found that there was an open Order of Conditions for the site for      the original subdivision.

        Mr. Alfieri inspected the site and found it to be in compliance with the original Orders of Conditions under this DEP file number.

There was a motion to issue the Certificate of Compliance.  The motion was seconded and accepted with a vote of 7-0-0.

        Discussion:  678 Pleasant Street - SE159-871
        Mr. Andy Bissanti, the realtor for the site, Mr. & Mrs. Thomas Grady, owners of the     property, and Mr. Donald Nielsen, Engineer of Guerriere & Halnon, all appeared before   the Commission for a discussion for possible use of this property.

        Mr. Bissanti stated that the Gradys would like to subdivide the site to enhance an      equestrian center that they own as an abutter to the site.  Mr. Bissanti informed the Commission that the applicant does not plan to take the house down.  There will be a
potential new house constructed on Green Street by the Gradys.

        Mr. Nielsen stated that there are riverfront issues on this site.  There will be remediation of a       portion of the riverfront in order to alter a portion of the outer riverfront in order to demolish      the barn., i.e., 140 ft. from the riverfront.  Mitigation and enhancement of the inner riparian zone of the riverfront will be provided along the river itself.  

        Mr. Nielsen stated that he will appear before the Commission with formal plans at a     future meeting to seek the opinion of the Commission as to the concept of the   proposed        plan.  A separate parcel will be created for the proposed house.

        The Commission was in general agreement with the concept of the proposed plans.
        The applicant will return to a future Conservation meeting with formal plans.

        Discussion:  Bent Street Water Line – DPW – CE159-935
        Mr. Bill Yadisernia, Town Engineer, appeared before the Commission and submitted the    actual drainage outfall monitoring results from the Bent Street Water Line project to the       Commission to be added to the file.

        Mr. Yadisernia stated that this submittal is a requirement of Special Conditon #51 in the       Orders of Conditions for the Bent Street Water Line project.  This special      condition       requires monitoring of the storm water at the site.  Some samples were taken by         DPW     staff and the results from the test lab are listed on this document.  This document     has     been added to the Conservation file.    



        Minor Buffer Zone Activity:  1 Wilson Road
        The applicant has requested the installation of a 15’x30’ above-ground swimming pool.  Mr. Alfieri stated that this site has a dropoff into a flood plain area and then into a wetland.  He recommended silt fence for erosion control at the top of the hill.  The stockpile is to be removed from the site.  A closed cartridge filter system is to be used in the pool.  The pool would be installed 30 ft. from the resource area.  

The Commission requested that Mr. Alfieri conduct a site walk of the site in order to determine an overall measurement from the wetlands to the location of the pool to determine if it complies with the requirements of a minor buffer zone activity filing.  

The Commission also requested that the applicant provide the Commission with more information.

The Commission tabled this filing until the next Conservation meeting until these determinations are made and more details regarding the site are determined.
